A bankruptcy discharge releases individual debtors from personal liability for the debt and prevents the creditor owed that debt from taking any collection actions against the debtor. In other words, you are no longer responsible for repaying the debt, and the creditor can no longer attempt to collect from you.

The U.S. Bankruptcy Code lists categories of debts that cannot be discharged in Chapter 7 and Chapter 13. While the specifics vary somewhat among the different chapters, the most common examples of non-dischargeable debts are:

  • Alimony
  • Child Support
  • Educational Loans
  • Secured Loans
  • Income Taxes
  • Bills for Luxury items
  • Debts arising from drunken driving, willful and malicious injury, or fraud.
